EasyQue Terms and Conditions (T&Cs)

By accessing or using the EasyQue mobile application or its associated web services, you agree to be bound by these Terms and Conditions and our Privacy Policy.

 

I. General Terms of Service & EasyQue’s Role

 

1. Acceptance, Eligibility, and Service Scope

  • Acceptance of Terms: Users agree to abide by these T&Cs and the Privacy Policy upon using the app or website.

  • Eligibility: Users must be of legal age (e.g., 18) to enter into binding agreements.

  • Service Scope: EasyQue is a facilitator of queue management and booking. We are not responsible for the quality, delivery, or outcome of the service provided by the third-party organization (the Organization / Consultant / Attendant).

 

2. Content and Data Responsibility

The Organization Admin is responsible for setting and maintaining all organizational details, images, user lists, and uploads via the 'My Organization' page. The content and its public reflection are the full responsibility of The Organization, not EasyQue.

 

3. Intellectual Property (IP)

All content, logos, software, and technology related to EasyQue are the property of the EasyQue company.

 

II. Booking, Queuing, and Service Terms (Guest Focus)

4. Live Queue Reliance and Disclaimers

  • Live Queue Reliance: The live queue position is an estimate and is subject to change based on the Service Provider's actions, unforeseen delays, or system adjustments. EasyQue is not liable for minor variations in predicted wait times.

  • Data Accuracy: The accuracy of the Live Status relies solely on the Organization’s users updating serving tokens promptly. If any Attendant fails to update a token's status (e.g., missing the "served" button), the Live Status Webpage may provide wrong information. EasyQue will not be responsible for any consequences caused by such user error.

  • Right to Refuse Service: The Service Provider (clinic, bank, restaurant) retains the right to refuse service to a Guest for organizational reasons (e.g., disruptive behavior, health concerns), even if a token was issued.

  • No-Show Policy: A "No-Show" (e.g., missing the turn, failure to arrive within a grace period) may result in automatic cancellation and potential loss of the platform fee.

  • Token Validity: The Organization may define the time limit or geographic radius within which a virtual token remains valid (e.g., the Guest must be physically present when called).

 

III. Financial Terms and Subscription (Organization Focus)

5. Subscription, Trial Period, and AutoPay

  • Subscription Basis: Subscription is on a monthly basis.

  • Free Trial: You can use the app for free for 7 days. If the subscription is not purchased after the trial, it will be cancelled without prior notice.

  • Pricing: Payment is based on the monthly basic platform fee multiplied by the number of active users. EasyQue reserves the full right to change/update this fee.

  • AutoPay Requirement: Once the first payment is completed, you must set up an AutoPay arrangement. If AutoPay fails or is cancelled, your subscription will be terminated without prior notice after a series of follow-ups.

  • Payment Confirmation: If payment is credited but subscription failed, you must contact us with a payment screenshot for immediate assistance.

 

6. Platform Fee for Guests (₹2)

  • Platform Fee (₹2): The ₹2 fee is a non-refundable administrative charge for the Guest’s use of the EasyQue platform.

  • Fee Non-Refundable: The ₹2 platform fee is not refundable under any circumstances, including cancellation, no-show, or service delay.

  • Service Charges: EasyQue does not handle or refund any fees or costs charged directly by the third-party Service Provider.

  • Payment Security: Payments are handled by a third-party payment gateway; EasyQue does not store full credit card details.

 

7. User Limit and Credential Sharing

If more users are detected than the set limit, or if credentials are shared across multiple users, EasyQue reserves the full right to cancel or deactivate the subscription. Limits can be increased by contacting EasyQue and confirming payment.

 

IV. Legal, Liability, and Termination

8. User Conduct and Account Management

  • Accurate Information: All users must provide accurate, complete, and current information.

  • Prohibited Use: Users are prohibited from using the app for illegal activities, spamming, exploiting vulnerabilities, or harassing staff/users.

  • Legal/Misconduct Responsibility: Any misuse of the application by users in an organization will be the sole responsibility of that Organization. By subscribing, the Organization warrants that it will never use the app for illegal activities and will keep user data private.

 

9. Limitation of Liability and Warranties

  • Disclaimer of Warranties: The app is provided "as is," and EasyQue makes no guarantees regarding continuous, error-free operation, or the availability of any Service Provider.

  • Liability Cap: EasyQue's liability for any damages arising from app use is limited to the maximum extent permitted by law (often limited to the amount of the platform fee paid).

  • User Knowledge: Easyque will not be responsible for financial loss or reputation issues caused by your lack of knowledge in handling the app's functionalities.

  • External Ratings: EasyQue is not responsible for any content or ratings on external platforms like Google Reviews, as they are not in our control.

 

10. Indemnification (Crucial)

The Organization agrees to indemnify, defend, and hold harmless EasyQue, its affiliates, and its officers from any and all claims, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from the Organization's use of the EasyQue platform, especially those related to customer disputes, misuse of the app, or violation of these T&Cs.

 

11. Force Majeure

EasyQue shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of nature, war, terrorism, embargoes, strikes, or widespread power or internet outages.

 

12. Governing Law and Jurisdiction

These T&Cs shall be governed by and construed in accordance with the laws of [Insert Governing Law, e.g., India], without regard to its conflict of law principles. Any legal action arising from these T&Cs shall be exclusively brought in the courts located in [Insert Jurisdiction, e.g., Bangalore, Karnataka].

 

13. Termination and Changes to Terms

  • Termination: EasyQue reserves the right to suspend or terminate any account that violates these T&Cs. Subscription may be cancelled without a prior notice if terms are not fulfilled.

  • Changes: EasyQue reserves the right to modify these T&Cs at any time. We will provide notice of material changes by posting the updated T&Cs on our website or app. Continued use of the service constitutes acceptance of the revised T&Cs.

 

V. Data and Privacy

The collection and use of personal data are governed by the separate Privacy Policy, which is incorporated by reference into these T&Cs.

II. How We Use Your Information

We use the collected information for the following purposes:

  1. Service Provision: To operate, maintain, and provide the core functions of EasyQue (e.g., creating virtual tokens, sending real-time queue notifications, processing bookings).

  2. Account Management and Billing: To manage Organization subscriptions, process platform fees, and handle billing inquiries.

  3. Communication: To send technical notices, updates, security alerts, and support messages.

  4. Security and Fraud Prevention: To protect against unauthorized access, maintain the security of our services, and verify user identities.

  5. Analytics and Improvement: To monitor and analyze usage and trends to improve the functionality and user experience of EasyQue.

  6. Marketing and Promotions: With your consent (or where legally permissible), to send promotional communications related to EasyQue or partner services.

 

III. Sharing and Disclosure of Information

 

We will not share or sell your Personal Information to third parties, except in the following limited circumstances:

  1. With the Service Provider (The Organization): We share the Guest's Name and Mobile Number with the Organization from which the service is booked so they can identify the Guest and provide the requested service.

  2. Third-Party Service Providers: We share necessary data with vendors, consultants, and other third-party service providers who perform services on our behalf, such as:

    • Payment processors (for billing).

    • Cloud hosting providers (for data storage).

    • Communication platforms (for SMS and email notifications).

  3. Legal Compliance: To comply with applicable laws, regulations, or legal processes (e.g., in response to a court order or government request).

  4. Business Transfers: In connection with a merger, sale of company assets, financing, or acquisition of all or a portion of our business.

  5. With Consent: We may share information with third parties when you give us consent to do so.

 

IV. Data Security and Retention

A. Security Measures

EasyQue implements commercially reasonable technical and organizational security measures designed to protect your Personal Information from unauthorized access, disclosure, alteration, and destruction. However, no internet transmission is 100% secure, and we cannot guarantee absolute security.

B. Data Retention

We retain your Personal Information for as long as your account is active or as needed to provide you with the Service. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

 

V. Your Choices and Rights

  • Account Information: Organizations can review, update, or correct their account information at any time by logging into their account settings.

  • Opt-Out of Notifications: Guests and Organizations can opt out of receiving promotional emails from us by following the unsubscribe instructions in those emails. You may also adjust notification preferences within the app settings.

  • Access/Deletion Requests: You may request access to the personal data we hold about you or request deletion of your account. We will honour these requests subject to legal and technical constraints.

 

VI. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by revising the "Last Updated" date at the top of the policy and, in some cases, providing more prominent notice (such as adding a statement to our homepage or sending you an email notification).
